Policy regarding subpoenas

County will comply with all federal and state subpoenas for open records in civil and criminal cases.

Subpoena for the production of documents

Answer 2

Courts liaison is responsible for accepting and distributing subpoenas for documents and evidence.

DUI arrest subpoena will be forwarded to the arresting officer.

All others are forwarded to the office of the chief.

Where do open records request go

Answer 3

Evidentiary materials, cad calls, and audio tapes will be forwarded to the office of the chief immediately.

Request for crime analysis will be forwards to the crime analysis unit

Civil action / lawsuits

Answer 4

County employees can be sued for conduct on the job and will be served with papers.

Can be served personally by a sheriff’s deputy, US Marshall, or process server. Can also be served through the mail.

What should officers do if served with civil papers

Answer 5

Send copies of the papers to the office of the chief within 5 days of receiving, make copies for personal record. Never sign the papers.

Department may deny defense if papers are sent outside of 5 days or actions were outside of policy.
