What is S32 of the Policing Act - Identifying particulars of a person in custody
Enables Police to obtain information that may be used now or in the future.
May take ID particulars of a person who is in lawful custody if the person is detained for committing an offence
Identifying particulars means the person’s name, DOB, address, photograph, and fingerprints
What is Section 33 - identifying particulars for summons
GCS a person of committing an offence and who has been summons, may detain person to take persons identifying particulars
If fails to comply after being cautioned it is an offence and can be arrested/charged
Section 36 - Care and protection of intoxicated people
Person must be in public place
IF they are incapable of protecting themselves from harm, likely to cause harm to others or property, and it is not practical to take them home or to a shelter,
May detain for up to 12 hours and be released as soon as they are sober
