Define a child and young person
Child under the age of 14yrs
Young person over 14 but under 18. Does not include any person who has been married or in a civil union.

The welfare and interest of the child or young person shall be the first and paramount consideration

- wellbeing of the child is entwined with that of their family
- child’s wellbeing is to be promoted by or through the family to the fullest extent possible
- child is to be severed from the family to the last extent necessary, and only as a last resort

Place of safety warrant
May enter and search if reasonably believe CYP has suffered injury or likely to suffer, can REMOVE and DETAIN and PLACE the CYP in custody of CYFS

Believe it’s CRITICALLY NECESSARY to protect CYP, ENTER and SEARCH, REMOVE and DETAIN, and PLACE CYP in the custody of the CYPFS

FOUND UNACCOMPANIED, PHYSICAL or MENTAL HEALTH likely or being IMPAIRED, can TAKE and DELIVER into the custody of parent etc,
No consent- PLACE into custody of CYPFS

Arrest of child or young person without warrant
- witness interference
- ensure appearance in court
- ensure no further loss of EM
- prevent further offending
Exceptions: EBA, public interest, cat 3 and 4 Offences
