Section 95
Suspending licences for 28 days
- Breath alcohol over 650mcg per L of breath
- Blood alcohol over 130mgm per 100ml of blood
- Breath alcohol over 400 mcg per L of breath and has been convicted for relevant offence with the last 4 years
- Breath alcohol over 80 mgm per 100ml of blood and has been convicted for relevant offence with the last 4 years
- Person failed or refused a blood test
- Person drove 40kph over speed limit
- Person drove 50kph over any temp speed limit
Section 96
Seizing and impounding vehicles for 28 days.
- person drove were disqualified from holding or obtaining a license.
- they had a suspended or revoked license.
- not holding a license: expired or unlicensed and they had previously been forbidden to drive.
- breath alcohol over 400mcg of alcohol per L of breath and 2 previous convictions within 4 years.
- blood alcohol over 80mgm of alcohol per 100ml of blood and 2 previous convictions with 4 years.
- failed or refused a blood test at the request of an officer, at a hospital and 2 previous convictions with 4 years
Section 114
Stop vehicles and demand details. Can stop for up to 15min, can arrested without warrant if person fails to stop, comply, supply
