What happens when a licensee enrolled in the military has an expired license?
*Any licensee or registrant of any board, commission or bureua within the department, whose license expired while on active duty may upon application, reinstate his/her license of registration without examination or penalty, provided the following:
-His or her license was valid at the time they entered the armed forces
*-The application for reinstatement is made while serving in the forces or not one year later from the date of discharge from active service or return to inactive military service.
-The application for reinstatement is accompanied by an affidavit showing the date of entrance into service or date of discharge, and the renewal fee for the current renewal period in which the application is being filed.
-If the application is sent in more than 1 year after discharge, or if the individual has not practiced while on active duty they may need to retake the exam
- You are also required to keep your license in good standing while you are actively enrolled.
Time spent by a licensee in receving treatment or hospitalization in any veterans facility during which he/she could not practiced shall be excluded from said period for one year.
What acts are considered a misdemeanor?
Any person who does any of the following is guilty of a misdemeanor:
A canceled, revoked, suspended, or fraudulently altered license
-A false license or any document simulating licensure or purporting to be or have been issues a license
-Lends his or her license to any other person or knowingly permits the use thereof by another
-Displays or represents any license not issues to him or her as being his or her license.
-Fails or refuses to surrender to the issuing authority upon its lawful written demand any license, registration, permit, or certificate which has been suspended, revoked, or canceled.
-Knowingly permits any unlawful use of a license issues to him/her.
-Photos, duplicates, manufactures, or in any way repoduces any license in a manner that it could be mistaken as a real licene
-Buys or receives a fraudulent, forged, or counterfeit license knowing it is fradulent.
What charge is given for a person to engage in subverting licensing exams? What is the fine?
It is a misdemeanor for any person to engage in any conduct which subverts or attempts to subvert any licensing exam or the administration of an exam, including but not limited to:
conduct which violates the security of the exam materials
-communicating with other test takers regarding exam material
-In addition to any other penalities, a person found guilty shall be liable for the actual damages sustained to the agency administering the exam not to exceed $10,000 and the cost of litigation.
A fee will not exceed what amount for fraudulent billing sent to an insurance company, the MediCal program, or Medicare?

How much time do you have to inform the board of a change of address, and what are the consequences of not doing so?
Each licensee shall notify the department at its principal office of any change in his/her mailing address within 30 days after the change, unless the board has specified regulations that are a shorter time period. Failure to do so constitutes grounds for the issuance of a citation and administrative fine, if the board has the authority to issue citations and administrative fines.
What must you tell your patient about your educational background?
Name, state where you got your license from, the highest degree earned, specialty certifications, and the school where you earned your degree.
What is the fine for accepting a rebate/refund/commission under the Division or the Chiropractic Initiative Act?
The offer/delivery/receipt/acceptance by any person licensed under this division or the Chiropractice Initiative Act of any rebate/refund/commission/preference/patronage dividend/discount/other consideration, whether in the form of money, or otherwise, will pay a $50,000 fine. Could also go to county jail for no more than 1 year, imprisonment in a state prison, or both fine and imprisonment. If there are 2 subsequent convictions that is punishable by imprisonment in the state prison or by imprisonment in the state prison and a $50,000 fine.

It is unlawful for any person licensed under this division to disseminate any form of public communication containing a false, fraudulent, misleading, or deceptive statement, claim, or image for the purpose of inducing, directly or indirectly, the rendering of professional services or furnishing of products in connection with the personal practice or business for which they are licensed.

Are we allowed to provide nutritional advice, and if so, what must be stated?
This chapter does not prohibit any persons from providing nutritional advice or giving advice concerning proper nutrition. For purposes of this sectiom, the terms “providing nutritional advice or giving proper nutirition advice” means the giving of information as to the use and role of food and food ingredieitns, including dietary supplemtents. ** Any person in commerical practice providing nutrtional advie or giving advice concernig proper nutrition shall post in an easily visible and prominent place the following statement in their business: “NOTICE” State law allows nay persont o provide nutritional advice, which is the advice as to the role of food and food ingredients, including dietary supplements.The state law does not confer authority to practice medicine or to undetake diagnosis, prevenion, treatment, or cure of any disease, pain, deformity, injury, or physical or mental condition and specifically does not authorize any person other than the one who is licensed health practitioner to state that any product might cure a disease/condition/disorder. The notice shall be no smaller than 8.5 by 11 inchs and shall be legibly printed with lettering no smaller than 1/2 inch in length, except NOTICE should be in 1 inch font
What happens if you let your license expire for longer than 5 years?
A person who fails to renew their license within 5 years after its expiration may not renew it, and it may not be reissued, or restored thereafter, but that person may apply for and obtain a new license if they:
- have not committed any criminal acts/grounds for denial
- take and pass the exam
- pays all fees required as if it is application for first time licensure
- A license which is suspended is subject to expiration and shall be renewed as above.
- A license which is revoked for unprofessioanl conduct is subject to expiration but it shall not be renwed. If reinstated, you pay the reinstatement fee which is an amount equal to the current renewal fee, plus the deliquency fee if applicable.
How many shares can licensed professionals hold in a profesisonal corporation and how many persons owning shares can there be in comparison with the governmental agency employees?
The following licensed persons may be shareholders, officers, directors, or professioan employees of the professional corporations designated in this section so long as the sum of all shares owned by those licensed persons does not exceed 49 percent of the total number of shares of the professional corporation so designated herein, and so long as the number of tose licensed persons owning shares in the professional corporation so designated herein does not exceed the number of persons licensed by the governmental agency regulating the designated professional corporation
Any health practitioner must report a patient with wounds if:
Any person suffering from any wound or other physical injury inflicted by his or her own act or inflicted by another where the injury is by means of a firearm
Any person suffering from any wound or physical injury inflicted upon the person where the injury is the result of assaultive or abusive conduct.
- Any health practitioner must make a report regarding the persons described to a local law enforcement agency as follows: a report by telephone shall be made immediately or as soon as possible.
- A written report will also be completed and sent to the law enforecement agency within 2 working days.

The report will include:
1. The name of the person, if known
2. The injured person’s whereabouts
3. The character and extent of the person’s injuries
4/ The identity of any person the injured persons alleges inflicted the wound, other injury, or assaultive or abusive conduct
When two or more persons who are required to report are present and jointly have knowledge regarding the situation, and when there is agreement amongst these people as a team, the team may select an individual to make the reports. Any member of the team that has knowledge that this did not occur will then do the report.
If you do not report the previous activities, what is the punishment?
It is a misdemeanor, punishable by imprisonment in a county jail not exceeding 6 months, or by a fine not exceeding $1,000 or by both fine and imprisonment.
