What happens when a licensee enrolled in the military has an expired license?

A

*Any licensee or registrant of any board, commission or bureua within the department, whose license expired while on active duty may upon application, reinstate his/her license of registration without examination or penalty, provided the following:
-His or her license was valid at the time they entered the armed forces
*-The application for reinstatement is made while serving in the forces or not one year later from the date of discharge from active service or return to inactive military service.
-The application for reinstatement is accompanied by an affidavit showing the date of entrance into service or date of discharge, and the renewal fee for the current renewal period in which the application is being filed.
-If the application is sent in more than 1 year after discharge, or if the individual has not practiced while on active duty they may need to retake the exam
- You are also required to keep your license in good standing while you are actively enrolled.
Time spent by a licensee in receving treatment or hospitalization in any veterans facility during which he/she could not practiced shall be excluded from said period for one year.

A

Any person who does any of the following is guilty of a misdemeanor:
A canceled, revoked, suspended, or fraudulently altered license
-A false license or any document simulating licensure or purporting to be or have been issues a license
-Lends his or her license to any other person or knowingly permits the use thereof by another
-Displays or represents any license not issues to him or her as being his or her license.
-Fails or refuses to surrender to the issuing authority upon its lawful written demand any license, registration, permit, or certificate which has been suspended, revoked, or canceled.
-Knowingly permits any unlawful use of a license issues to him/her.
-Photos, duplicates, manufactures, or in any way repoduces any license in a manner that it could be mistaken as a real licene
-Buys or receives a fraudulent, forged, or counterfeit license knowing it is fradulent.

It is a misdemeanor for any person to engage in any conduct which subverts or attempts to subvert any licensing exam or the administration of an exam, including but not limited to:

-In addition to any other penalities, a person found guilty shall be liable for the actual damages sustained to the agency administering the exam not to exceed $10,000 and the cost of litigation.

This chapter does not prohibit any persons from providing nutritional advice or giving advice concerning proper nutrition. What happens if you let your license expire for longer than 5 years?

A

A person who fails to renew their license within 5 years after its expiration may not renew it, and it may not be reissued, or restored thereafter, but that person may apply for and obtain a new license if they:

  • have not committed any criminal acts/grounds for denial
  • take and pass the exam
  • pays all fees required as if it is application for first time licensure
  • A license which is suspended is subject to expiration and shall be renewed as above.
  • A license which is revoked for unprofessioanl conduct is subject to expiration but it shall not be renwed. If reinstated, you pay the reinstatement fee which is an amount equal to the current renewal fee, plus the deliquency fee if applicable.

A

When rendering physical therapy services as part of academic training, a physical therapy student shall be identified as that. A person who has complete all coursework may be identified as an intern. Again, font must be 18 point type.

  • The supervising PT shall provide on site supervision.
  • The PT student or intern will doc each treatment in the pt record, along with his or her signature. the CI/supervisor with countersign with his or her first initial and last name on all entries in the patient’s record on the same day as the patient related tasks were provided by the student or intern.

What does adequate supervision of a PTA mean

A

A PT shall at all times be responsible for all physical therapy services provided by the PTA and shall ensure that the PTA does not function autonomously. The PT has a continuing responsibility to follow the progress of the patient, and is responsible for determining which elements of treatment may be assigned to the PTA.

  • the PT that performs the initial eval is considered the PT of record and shall remain as such until that patient is transferred to another PT of record. The PT of record shall ensure that a written system of transfer to the succeeding PT exists.
  • The PTA shall be able to identify, and communicate with, the PT of record at all times during the treatment of the pt.
  • A PTA shall not:
    1. Perform measurement, data collection or care prior to the eval of the pt by the PT
    2. Document patient eval and re-eval
    3. Write a discharge summary
    4. Establish or change the plan of care
    5. Write progress notes to another health care professional, as distinguished from daily notes
    6. Be the sole PT representative in any meeting with other health care professionals where the patient;s plan of care is being assessed or modified
    7. Supervise an aide performing patient related tasks
    8. Provide treatment if the PTA holds a management position in the business where care is being provided.

The PTA shall
1. Notify the PT of record, document in the patient record any change in the patient’s condition not within the planned progress or treatment goals, and any change in the patient’s general condition.

A

A citation shall be destroyed from all licensee records 5 years from the date of issuance or if one or more subsequent ctiations is issued within that 5 year period, 5 years from the date the last citation was issued.

Yes, but only if they are certified by the board to perform such tests or such practice is appropriately supervised. For kinesiological EMG, even if you are certified you must have additional authorization from the board.

A

This study has bene performed in accordance with the Physical Therapy Practice Act and with the Physical Therapy Regulations. The findings in this report do not represent diagnostic interpretations or medical diagnoses. The results of the exam by the certified electromyographer are intended for integration by the physician and surgeon with the patient’s history, clinical exam, and the results of any other tests performed in establishing a medical diagnosis.

How do you document a course or activity?

A

Each licensee shall keep and maintain records showing that each course or activity for which credit is claimed has been completed. Those records shall reflect the title of the course/activity, the date taken or completed, and the record of participation. Each licensee shall retain such documentation for a period of 5 years after the course or activity concludes and shall provide copies of such documentation to the board or its designee upon request.

A

Out of the country for 1 year or more, in the military and not in california for 1 year of more, ill for one year, taking care of ill family member for 1 year. Note that this exemption will not be granted for 2 consecutive renewal periods.
