If the deceased lives IN New York STATE, then the person would have to go to the Surrogate’s Court of County where deceased lived.

Ex: Person dies in Brooklyn and lives in Buffalo, NY. Other person will have to go Court in Buffalo.

If the deceased lives OUTSIDE New York STATE, then the person would have to go to the Surrogate’s Court of the County in which the property is located.

Ex: Person dies in Brooklyn and lives in New Jersey. Other person will have to go to Court in Brooklyn.
