What are the 2 types of warrants?
Bench warrant- magistrate issues
Charge and warrant to arrest- initiated by Police
S77B CA Parole - Arrest with a warrant
Police and PSOs od @ dp are authorised to apprehend a prisoner under warrant. In the case of a PSO, the prisoner can only be apprehended if they are at or in the vacinity of the designated place.
PSOs must hand over any prisoner apprehended to MOPF
S78B CA Arrest without a warant
In a ddition to apprehending a prisoner under warrant , a PSO od @ dp aslo has the power under S78B(1) to arrest prisoner if they SORG that the prisoner has committed an offence against S78A
For a PSO to arrest, the prisoner must be at or in the vacinity of a dp
S598A CYFA Emergency care warrant
A PSO who is od @ dp may apprehend a child named in an emergency care warrant provided the child is at or in the vacinity of the designated place
PSOs must hand over the child into the custody of a police officer as soon as praticable.
