Standard of Care
the benchmark the courts use to determine the actions of the reasonably competent professional school counselor.
The Ethical Decision-Making Model:
- Identify the emotional reaction.
- Examine the facts. 3. Review the relevant ethical guidelines.
- Consider parental rights.
- Consider the setting.
- Consider the chronological and developmental levels.
- Identify the nature and dimensions of the problem.
- Consult.
- Consider possible and probable courses of action.
- Examine the good and bad consequences of various decisions.
- Implement your course of action.
Informed consent:
given at beginning of counseling session - counselee will know purposes, goals, techniques, and rules of procedure of the counseling.
FERPA (Family Educational Rights and Privacy Act):
federal law that governs the disclosure of information from educational records & gives parents certain rights that include the rights to talk to teachers and school administrators about their children, see their children’s educational records and decide if their children will participate in a questionnaire, survey, or examination regarding a parent’s personal beliefs, sex practices, family life, or religion.
Sole Possession Records: One of the six categories exempt from education records under FERPA is “sole possession records.” Sole possession records, case notes must meet three requirements:
Private, created solely by the individual possessing it
Created to be a personal memory aid
Is not shared or accessible to any other person except the individual’s temporary substitute

American School Counselor Association (ASCA) code of ethics
A written set of guidelines issued to member school counselors to help them conduct their actions in accordance with the organization’s primary values and ethical standards
community standards
Local norms framing acceptable conduct.
confidentiality
The ethical principle or legal right that a school counselor will hold secret all information relating to a student, unless the student gives consent permitting disclosure.
duty of care
Burden of responsibility created under in loco parentis doctrine when a school counselor becomes aware of a student’s suicidal intent.
educational records
Any record directly related to a student which contains personally identifiable information and is maintained by the school or a party acting on behalf of the school.
in loco parentis
“in place of the parents.”
Informed consent
Permission granted in the knowledge of the possible
consequences, such as that which is given by a student to a school counselor for intervention with full knowledge of the possible risks and benefits.

Protects the civil rights of all individuals who are subject to discrimination in health and human services programs.
Prejudices
Preconceived opinions not based on reason or actual experience.
privacy rights
The qualified legal rights of a person to have reasonable privacy in not having his private affairs made known or his likeness exhibited to the public having regard to his habits, mode of living, and occupation.
privileged communication
Interaction between two parties in which the law recognizes a private, protected relationship.
Serious and foreseeable harm
A condition justifying breach of confidentiality by a school counselor under the ASCA Code of Ethics.
special relationship
Formed under in loco parentis doctrine when a school counselor becomes aware of a student’s suicidal intent.
standard of care
How similarly qualified school counselors would manage a student’s care under the same or similar circumstances.

Title IX
Part of the Education Amendments of 1972, Title IX protects people from discrimination based on sex in education programs or activities that receive Federal financial assistance.

Situations or statements that impart a personal value of the person involved that may not be true in the strictest sense but instead is based on personal opinion/values.
