What is the definition of a vicitm
A person against whom an offence is committed.
A person who, through, or my means of, an offence committed by another person, suffered physical injury, or loss off, or damage to property.
A parent or a member of the immediately family of a CYP who falls within the above 2, unless they are the person charged.
Section 7
Victims should be treated with courtesy and compassion and respect for the victims dignity and privacy.
Section 8
Victims who have welfare, health, counseling, medical or legal needs arising from the offence should have access to those services.
Section 11
A victim must be informed of programs, remedies and services as soon as practible.
Section 12
The prosecuting authority must advice the victim of the progress of:
-The investigation
-Charges filed or auction taken
-Date and place of proceedings
-Role of the victim as a witness
-Outcome if proceedings
Section 51
A person’s property (other than the property of the offender) held for evidential purposes must be returned as soon as practicable when its no longer required as evidence.
Section 29
Specified offences defined.
Police obligation under this section is to:
-Obtain the victims view about the accused or offenders release on bail are ascertained.
-The court is informed of these views.
-The victim is advised of the outcome of the bail application hearing when Police are opposing bail.
