What are 4 driving breaches?
- Inconsiderate driving (not paying attention, not indicating etc)
- Careless driving (Below driving standards, hitting a correctly parked car)
- Dangerous driving (Speed, manner)
- Reckless driving (knowingly, deliberate)
Reckless driving requires an elemant of intent that is absent in dangerous driving)
Section 115
Green and Pink stickers
-Pink, POL555, Unsafe (not in safe condition to be driven on road)
-Green, POL650, Defective (fails to comply with regulations or rules)
Section 116
Power of arrest if you have GCTS a person has failed to comply with a direction given under Section 113 or 115
Section 118
Demand details from owner of vehicle:
118(1)&118(2) Any owner or hirer must provide details of the identity of the driver and passenger withing 14 days if any offence has been committed against any Act and that car was involved.
118(4) Any owner or hirer must provide all info to identify the driver immediately if an offence has been committed against the LTA.
Section 119
Power of entry to carry out EBT
May enter premises w/o warrant if GCTS that any:
-Person fails to stop for flashing lights or siren
-Committed reckless or dangerous driving
-Driving under influence of drink/drug or both
-Freshly pursuing that person
Section 121
Taking keys and forbidding to drive
-Forbid a person to drive for a specified time
-All keys to be surrenderd
-Render the vehicle immobile
-Move or cause vehicle to be moved
-EBA offenders forbidden to drive for 12 hours
-Direct a person to a place of rest
121(4) Power to arrest if anyone fails to comply with directions or attempts to do an act forbidden by Section 121
Section 122
Emergency power to seize vehicle for up to 12 hours if you have RGTB that it is the interest of public safety.
Section 123
Power to seize vehicle for 10 days in order to:
-Preserve evidence
-Enable scientific examination
-Establish the cause of a serious accident
Section 90
Suspension from driving for 3 months if a person has accumulated a total of 100 or more demerit points in the last 2 years
Section 95
28 day suspension of licence if:
-BR over 650mcg
-BL over 130mgm
-BR over 400mcg + after previously being convicted of relevant offence in the last 4 years
-BL over 80mgm + after previously being convicted of relevant offence in the last 4 years
-Failed/Refused blood test
-40km/h over permanent speed limit
-over 50km/h over temporary speed limit

-Disqualified from holding/obtaining license
-Suspended/revoked license
-Interlock license holder breaches conditions
-Unlicensed/Forbidden
-Operate in a race or unnecessary exhibition of speed
-Fails to stop or remain stopped under Section 114
-BR over 400mcg + 2 convictions last 4 years
-BL over 80mgm + 2 convictions last 4 years
-Fails/Refuse blood test + 2 convictions last 4 years
-Sustained loss of traction

What is Careless driving?
Failing below the driving standards of a reasonable prudent motorist: indicating left and changing your and turning right into the path of an overtaking car. Colliding with a correctly parked car.
What is Reckless driving?
Knowingly and deliberate driving running risking injury or collision: Knowingly trying to outrun a patrol car, endangering public safety, Driving through a stop sign knowing that they would not be able to stop if required too.
What is dangerous driving?
Driving in a manner or speed which was or might have been dangerous to anyone: Driver on a 2 lane road pulling out to overtake on the wrong side of the road in the face of incoming traffic, Driving 80lm/h at 8.30am in a 50km/h area in presence of school/childeren
What is Inconsiderate driving?
Driving that includes inattention or thoughtless actions or omissions as well as deliberate ones which is inconsiderate to other road users: Driving at low speed as to hinder others, Not taking reasonable steps to allow a line of following vehicles to pass.
