Who can apply for a protection order?
-A person who is or has been in a relationship
-A representative of a person lacking capacity
-A representative or an approved organisation (womans refuge)
If the applicant is for a child under 16:
-Approved representative
-Without representative if authorised by the court
Standard conditions of a Protection Order
-No violence
-No contact
-No weapons
Who is the Victim and who is the Subject of the order (PO)
Applicant = Victim
Respondent = Subject of the order
After how long does an PO become permanent?
After 3 months if not challenged.
How long does a respondent have to hand in firearms?
No later than 24 hours.
When a person breaches a PO they will be:
Arrested and hekld in custody for 24 hours (Cooling off period) immediately following the arrest before releasing on bail.
Standard conditions for a PSO
-Immediatly surrender weapons & firearms licence
-Vacate land/building
-No physical/sexual violence
What are the parties involved in a PSO?
Person at risk (Victim)
Bound person (Offender)
Who can issue a PSO and for how long?
Police if authorised by Sergeant, no consent from victim is needed.
Up to 10 days.
Info we must provide to bound person and PAR?
-Purpose of the order
-Effect of the order
-Duration of the order
-Consequences of contravening the order
Timeframe to serve PSO to bound person?
Within 48 hours of being issued or the order lapses.
Court option for breach of PSO?
Issue PO
Issue new PSO
No further action
