Torts (intentional):
What is the difference between assault and battery?
A
- assault: threat or attempt to make bodily contact with another person with or without that persons permission
- battery: assault that is carried out. Includes willful, angry, violent or negligent touching of another persons body or clothes or anything attached to or held by that other person. Battery also results when a HCP performs a procedure that goes beyond the scope of the patients consent.

Explain malpractice duty, breech of duty, causation, and damages….
A
- duty: obligation to use due care
- breech of duty: failure to meet standard of care
- causation: failure to meet standard of care (breech) caused the injury (hardest part to prove)
- damages: actual harm or injury resulting to pt
