Define Section 12 Theft Act 1968
Person shall be guilty of the offence if without consent of the owner or other lawful authority he takes a conveyance for his own or another’s use
or knowing that any conveyance has been taken without such authority he drives it or allows himself to be carried in or on it
What is a conveyance
Anything constructed or adapted to carry a person by land air or water
When would person NOT commit an offence of TWOC
Believes he has lawful authority to do so
That he would have the owner’s consent if owner knew of the circumstances
Explain Section 12A Theft Act 1968
A person is guilty of aggravated taking of a vehicle if
He commits an offence under section 12 Theft act 1968 in relation to a mechanically propelled vehicle
AND
It’s proven that at any time after the vehicle was unlawfully taken that:
- The vehicle was driven dangerously on a road or other public place
- Owing to the driving of the vehicle an accident occurred by which injury was caused to any person
- Owing to the driving of the vehicle an accident occurred by which damage was caused to any property other than the vehicle
- That damage was caused to the vehicle

When would a person NOT be guilty of an offence under Section 12A Theft Act 1968?
The driving, accident or damage occurred before he committed the basic offence
He was not in, on, or in immediate vicinity of vehicle when accident damage or driving occured
