A

If all your documents got damaged somehow. More for back in the day before digital times when offices would have copies of all drawings and printing was more expensive

If you are a sole practioner and then become part of an architecture company, can you cancel your personal PI insurance?

A

No. As you still need ongoing insurance for the project you did when you were a sole trader. Your premium however, may go down as time goes on but you will always need to have insurance for those projects.

Are you liable for all the work when you take it over halfway from another architect?

A

No. You are liable for what you have done. But keep in mind that if you have absorbed design into your drawings, you are then liable for that design.

Put the indemnity and warranty in your Contract.

A

This should be specified in your employee contract.

A

It does with the person unless they have signed it to someone in their will.

If it’s associated to the business it’s a commercial entity and it can be bought or sold on.

Are you liable for all the copies of your work?

A

Yes. If it’s a public toilet with a slippery floor finish that has been repeated over and over throughout the country, you are liable for who slips on any of those floors in any of the instances anywhere.

Even if the copyright is handed over to the government or whoever.

A

Yes. But no-one seems to mind or worry about it. Moral rights should be considered however.

A

No but you need to notify them. You do not need their permission.

What moral rights do you hold to work you do under an employer?

A

You have complete moral rights to all work you do under your employer, however…

you may not have copyright due to employers usually writing in their employee contracts that all work done under the company is copyrighted to the company and therefore you may be able to be sued if you leave that company and repeat a design under another employer.

In terms of copyright, What must you do if you are taking over another architects project?

A

You can only talk to the previous architect if your client approves so.

You need to ask your client for a warranty that they have a license to use the previous architects and indemnity from any copyright to indemnify you from taking on any copyright liability.

It doesn’t matter how much you change their drawings, unless you never ever saw those drawings, you can get sued for copyright.
