What is Sports’s Law?
the law, regulations + judicial decisions that govern sports + athletes who perform in them.
Why has the law got involved in sport?
- more acts of deviance has lead to the authorities to make all of those involved in sport accountable
Why may a performer need sport’s law?
- Contract
- Injury
- Loss of earnings
Why is sports law needed in performer on performer situations?
Injuries are considered to be a side effect of partcipating in sport
- however a deliberate act to injury a player is illegal
Monetary compensation may be given to injured performers following dangerous tackles
What is an example of when performers needed the law due to loss of earnings?
USA Women’s Soccer Team
- took action against federation + filed a wage discrimination as their male counterparts were paid 4x more
- they lost the case
When may sponsors require sports law?
A brand suing a performer
- contractual disputes
What is restraint of trade?
- action that interfers with free competition in market.
In sport this might involve a clause in contract which restricts a persons’s right to carry out their profession
What was the Bosman Ruling 1995?
The ruling by the European Court of Justice giving a professional player the right to a free transfer at the end of their contract
- existing club cannot demand a contract fee
Why will sports law be needed for performers vs supporters?
Legal action against spectators for unacceptable behaviour such as running onto the pitch
e.g
- Feb 2013, Wycombe goalkeeper was attacked by a fan - a 17yr old was arrested and charged with assault
What is the definition of negligence?
Conduct that falls below a reasonable person standard and leads to a breach of duty of car which can result in foreseeable harm to another
What is the definition of duty of care?
A legal obligation imposed on someone if they are responsible for a group of people
In what situations would a referee be accused for negligence in?
- Injury caused by not applying rules correctly
- Injury caused by failure to check clothing/ footwear
- Injury caused by failure to check the safety of the surface before a match
- Injury caused by a failure to check the equipment
- Failure to stop the game due to an injury of a player
What do coaches have a legal responsibility for?
Health + safety
Protection from abuse
Supplements
Duty of care
What is loco parentis?
When children are involved, those in charge must act ‘in loco parentis’ which require a coach to act as a reasonable parent would.
How do coaches ensure they stick to health + safety?
- have access to first aid facilities
- be able to contact the emergency services
A coach would be liable if evidence shows that normal standards + practices were not followed
