Sexual activity with a child S9
A person aged 18 or over commits an offence if
He intentionally touches another person
The touching is sexual
Either
Is under 16 and not reasonably believe that they are under 16
Or
Is under 13
Sexual activity in presence of a child S11
A person aged 18 or over (A) commits an offence if
(A) he intentionally engages in sexual activity
The activity is sexual
For the purpose of obtaining sexual gratification he engages in it
When another person (B) is present or is in a place from which A can be observed and knowing or believing that (B) is aware or intending that B should be aware
Terms of observation
This will include directly looking at them or looking at an image
Exceptions to aiding, abetting or counselling
S afety of the child (protect)
T transmitted sexual infection (protect)
E emotional well being(promote)
P pregnancy (prevent)
And not for the purpose of
C causing or encouraging the sexual activity
O obtaining sexual gratification
P participation
