What is the aim of punishment of offenders?
The offender deserves it. An “eye for an eye, a tooth for a tooth and a life for a life”. Society and victim are being avenged.
What is the aim of Protection of the Public?
Protect the public from violent or prolific offenders by incapacitating them so they don’t reoffend.
What are 2 examples of Protection of the Public?
Electronic tagging
Custodial sentence
What is the aim of deterrence?
Putting of an individual or the public from committing an offence.
How do courts deter an individual?
A suspended sentence or conditional discharge.
How do courts deter the public?
Making examples of cases - severe sentences to scare everyone else. Needs publicity to work.
Rehabilitation comes under deterrence what is the aim of it?
Forward looking to stop someone reoffending. Aimed at young offenders.
What is an example of rehabilitation?
Community sentences like treatment requirements.
What is the aim of reparation?
Compensating the victim.
Examples of reparation?
Pay money -benefits victim
Unpaid work- benefits society
Courts have to provide a reason if they do not make a compensation order, what Act covers this?
