What is imprisonment?
A sanction that involves the removal of the offender from society by the state, which will result in the loss of the offenders freedom and liberty for a stated period of time in prison.
What is parole?
Parole is the supervised and conditional release of a prisoner after the minimum period of imprisonment had been served.
- If a court sentences an offender to more than two years in prison, it must give a minimum non-parole period.
- If the sentence is between 1 and 2hears in prison, the court has the option to set a minimum no parole period.
Custodial vs no custodial sentence???
- A custodial sanction has a prison term attached.
- A non custodial sentence has no prison term attached. E.g a fine.
What is a concurrent and cumulative sentence?
- A concurrent sentence runs at the same time as another sentence. E.g 4 years murder and 2years theft but only serves 4years.
- A cumulative sentence is served straight after another sentence. E.g 4 years for murder and 2for theft. Serves a 6 year sentence.
What is an aggregate sentence?
If an offender is charged with multiple similar offenses, the court may impose an aggregate sentence. This is where one sentence is given for all the crimes, rather than a specific sentencing for each crime.
