Punishment
penalise and punish the offender and show society and the victim that criminal behaviour will not be tolerated.
A fine can be a punishment
Deterrence
Aimed at discouraging people from committing similar crimes. Whether deterrence is relevant will depend on the circumstances of the case, There are two types of deterrence
General deterrence
The purpose of this is to discourage or deter others from committing offences because they see the consequences of committing that crime.
important in violent or serious offences, such as homicide or sexual offences where vulnerable members of society are affected, or in relation to public, violent acts of crime
Specific deterrence
This is when the court seeks to discourage a particular offender from engaging in criminal activity in the future
Protection
to ensure that the community is safe from any further harm that can be caused by the offender. Sometimes it is necessary to remove the offenderfrom the community (put them in prison) to achieve this aim.
non-custodial sentence (not in prison) such as CCO, can also protect the community from the offender because it keeps them busy when they otherwise be engaged in criminal activity.
Denunciation
Refers to the disapproval of the court. A sanction may be given to show the community that the court and society disapproves of and condemns the offender conduct.
Rehabilitation
Designed to reform an offender in order to prevent them from committing offences in the future.
How can Rehabilitation be achieved?
CCO’s (community correction orders) which can encourage rehabilitation by requiring offenders to participate in skills training or to undergo alcohol and drug treatment.
Prisoners may be offered the opportunity to undertake life skills such as the Torch program or other program initiatives
How can rehabilitation effect sentencing
The offender must demonstrate remorse which can be seen through the offender’s actions after the offending e.g like a early plea, cooperating with police or taking active steps to address their behavior.
