Definition of robbery

A

‘A person is guilty of robbery if she steals and immidiately before or at the time of doing so, uses force on any person or seeks to put any person in fear of being subjected to force

What is the first element required for robbery?

A

There must be a completed theft for a robbery to have been committed, all elements of the theft should be completed
R v Waters - No evidence to establish D had intention to permanently deprive V of her phone - so not all elements of theft were fulfilled, so no robbery

A

Prosecution must prove there was force or threat of force
R v Dawson & James - pushed victim, other D stole V’s wallet
R v Clouden - CoA held that D was guilty of robbery when he wrenched a shopping basket from V’s hand
