What is the difference between theft and robbery?
Robbery is theft with the use or threat of force.
What is the definition of robbery in section 8 of the Theft Act 1968?
A person is guilty of robbery if he steals, and immediately before or at the time of doing so, and in order to do so, he uses force on any person or puts or seeks to put any person in fear of being then and there subjected to force.
According to the Theft Act 1968 can a person be charged with robbery if the force is inflicted after the theft?
No, as section 8 of the Theft Act 1968 states force has to be inflicted before or at the time of the theft. However when case law is applied it can be possible a robbery charge is tried.
When is a theft with force two separate charges rather then a robbery?
When the force is applied after the theft not before or during.
What type of court is robbery usually taken to?
Crown court.
