What is the minimum age for working on ship?
As per MSN 1848, 16 years of age.
What restrictions apply to those under the age of 18?
Those under the age of 18 years must not be assigned work which is likely to jeopardise their health and safety, unless they are fully qualified in the relevant skills or are working under supervision.
The employer must carry out a risk assessment with regard to the particular risks to young persons.
Those under the age of 18 years may not work at night unless as part of recognised training. In this context, “night” means a period of at least nine hours including the hours between midnight and 5 a.m. (local time)
Young persons should be provided with a minimum of 12 consecutive hours rest in every 24 hour period; and a rest period of at least 2 days in every week. Where a young person’s daily working time is more than four and a half hours, they should be provided with a rest break of at least 30 minutes which should be consecutive if possible.
Can the minimum 2 day rest period per week for young persons be changed?
Yes, can be changed to a minimum of 36 hours if justified by technical or organisational reasons.
What is a SEA under MLC?
As provided in MGN 477 the Seafarers employment agreement which is drawn up for each individual seafarer and contains their legal rights by contract
In what time frame must a ‘Notice to end employment’ be issued?
At least 7 days other than when granted on compassionate grounds or dismissal for gross misconduct.
At what interval must seafarers wages be paid as per MLC?
Not more than 1 month.
Any delay without reasonable cause shall result in the seafarer being entitled to 20% interest.
What is a companies duty to provide ‘Seafarers Allotment’ under MLC?
As provided in MGN 478 companies must provide seafarers with a way to send their income back to their families with no limit on the amount which may be sent.
What requirements regarding hours of rest and applicable under MLC?
As provided in MSN 1767 Seafarers must have a minimum 77 hours rest in any 7 day period.
A minimum of 10 hours rest in any 24 hour period of which must not be split into any more than 2 breaks with 1 being a minimum of 6 hours.
A schedule of hours of rest must be posted on the ship.
What does the MLC provide for seafarers in regards to complaints?
As provided in MSN 1849 every ship must have an onboard complaints procedure which must:
Seek to resolve at the lowest level possible.
Enable the seafarer to complain directly to master or appropriate external authorities.
Provide the right for the seafarer to be accompanied or represented.
Ensure that the seafarer does not suffer any detriment.
