77 : Health, hygiene and safe food practices
Approved Providers and Nominated Supervisors must insure that all staff and volunteers implement
a) Adequate health and hygiene practices and
b) Safe practices for handling, preparing and storing food - to minimise risks to children
78 : Food and Beverages
Approved Providers and Nominated Supervisors must ensure all children:
a) have access to safe drinking water at all times
b) are offered food and beverages appropriate to the needs of the child on a regular basis.
79 : Service providing food and beverages
The Approved provider and nominated supervisor of a service that provides food or a beverage must ensure that -
a) the food and beverage is nutritious and adequate in quantity
b) It is chosen having regard to the dietary requirements of the individual children taking into account
- each child’s growth and development needs
- any specific cultural, religious or health requirements
This does not apply to what is provided by a parent or family member.
80 : Weekly Menu
The approved provider and Nominated Supervisor must ensure that a weekly menu
a) Is displayed at the premises and is accessible to the parents
b) Accurately describes the food and beverages to be provided each day.
81 : Sleep and Rest
The approved provider and the Nominated supervisor must take reasonable steps to ensure that the needs for each child are met having regard to the ages, development stages and individual needs of the children.
82 : Tobacco, drug and alcohol free environment
The approved provider must ensure that the environment is free from the use of illicit drugs, tobacco and alcohol.
83 : Staff members and family day care educators not to be effected by alcohol or drugs
The approved provider must ensure that all staff or volunteers are not effected by alcohol or drugs (prescribed as well) so as to impair the persons capacity to supervise or provide education and care to children.
The NS must not consume alcohol or be effected by alcohol or drugs so as to impair the supervisors capacity to supervise or provide education.
84 : Awareness of child protection law
The Approved provider must ensure that nominated supervisors and staff are advised of the existence and application of the current child protection law and
Any obligation that they may have under that law.
85 : Incident, Injury, Trauma and Illness
The incident, Injury Trauma and Illness policies and procedures under reg 168 must include procedures in the event that a child is
- Injured
- Becomes ill
- Suffers a trauma
Notification to parents of incident, injury, trauma and illness
The approved provider must ensure that the parent is notified as soon an practicable, but no later than 24 hours after the occurrence of any incident, injury, trauma or illness.
87 : Incident, Injury, Trauma and Illness record
The approved provider must ensure a record is kept in accordance with this regulation.
It must include:
a) Details of the incident, illness or trauma including the name and age, the circumstances leading to the incident, the time and date. Also the symptoms of the child.
b) details of the action taken including
- any medication or first aid provided and any medical personnel contacted.
c) details of any witnesses
d) the name and time and date of anyone the service attempted to notify
e) the name time and date and the signature of the person making the entry
88 : Infectious disease
If there is an occurrence of an infectious disease, the approved provider must take reasonable steps to stop the spread and the approved provider must ensure that a parent or the emergency contact of each child is notified as soon as practicable.
89 : First aid Kits
The approved provider must ensure that first aid kits are kept
a) with the appropriate number of kits in regards to the number of children
b) the kits are suitably equipped.
The kits are easily recognised and accessible
90 : Medical Conditions Policy
The medical conditions policy must set out practices in relations to the following:
a) The management of conditions like asthma, diabetes or risk of anaphylaxis
b) Informing all staff and volunteers of the management of these.
c) Requirements arising if the child has specific health care needs, allergy or relevant conditions including:
1) Parent providing a medical management plan
2) Requirement for the plan to be followed specific to the needs of the child.
3) Requiring the development of a risk minimisation plan specific to the child’s needs:
- To ensure that the risks are assessed and minimised
- To ensure the safe practices of handling, preparation and consumption of food are developed.
- To ensure that practices and procedures to ensure parents are notified of any allergies that may pose a risk and strategies to minimise that risk are developed and implemented
- To ensure that practices and procedures ensure that all staff can identify the child’s medical management plan and the location of the medication are developed.
- To ensure that practices and procedures ensure that the child does not attend the service without their medication as prescribed are developed.
4) Require the development of a comms plan to ensure that all staff are informed about the meds management plan for the child and a child parent can communicate any changes that need to be made to the plan.
d) The medical conditions policy must set out practices in relation to self administration of medication by children over pre-school age if the service permits.
- The practice must include the recording of any self administered medication
91 : Medical conditions policy to be provided to parents
The approved provider must ensure that a copy of the medical conditions policy is provided if the provider is aware that a child has a specific health care, allergy or other relevant medical condition.
