90-Day Pre-Termination Review Investigation (TRM9)

A

Before an offender’s termination date, conduct an initial review, or a 90-Day Pre-Termination Review (TRM9), 90 days before an offender’s supervision termination date. A TRM9 is an investigation that analyzes the offender’s compliance with all conditions of supervision.

A TRM9 may reveal offender exceptions. Instruct the offender to resolve all exceptions 30 days before their scheduled termination date or notify the sentencing authority of non-compliance. When completing a TRM9 investigation, review the original court or sentencing authority documents, supervision orders, dispositions, and any modification orders contained in an offender’s case file.

Contact the clerk of court and service providers for confirmation of compliance or non-compliance with any special conditions of supervision after reviewing OBIS. Review criminal justice databases, such as NCIC, FCIC, CCIS, and local records, to ensure the offender has not had any new law violations. Document all exceptions during the TRM9 on the Pre-Termination Review form and submit to your supervisor for approval.

Your supervisor will review the TRM9 and verify for accuracy. Upon completion, the supervisor will approve and sign the TRM9 investigation. If the supervisor identifies any exceptions, they will notify you and assign a 30-Day Pre-termination Review investigation (TRM3). The TRM9 and TRM3 are OBIS-generated investigations assigned to officers before a scheduled offender termination date.

When an offender reaches 120 days before their scheduled termination date, the system generates and assigns a TRM9. The same is true for the TRM3; however, OBIS will generate the investigation 60 days before the scheduled termination date.

30-Day Pre-Termination Review Investigation (TRM3)

A

The TRM3 is a follow-up investigation to the TRM9 that verifies you have resolved all offender exceptions in OBIS. Complete the TRM3 using a section of the Pre-Termination Review form initiated during the TRM9. TRM3 investigations are due 30 days prior to an offender’s supervision termination date.

This investigation documents unresolved exceptions on the Pre-Termination Review form. Submit the completed form, with a violation report outlining the unresolved exception, to the sentencing authority or the clerk of the court. Submit a “Notification of Scheduled Termination with VOP Pending” form letter to the sentencing authority 30 days before the scheduled termination date if an offender under supervision has a pending violation of probation (VOP) hearing scheduled beyond the offender’s scheduled termination date.

The letter notifies the sentencing authority that the Department no longer has the authority to supervise the offender after the scheduled termination date.
Some offenders have multiple termination dates as they may have separate cases, different sentence lengths, or different start dates. Conduct Pre-Termination Reviews for each termination date.
