the poisons (N.I) order 1976 part I
(i) lawfully conducting a retail pharmacy business
(ii) sale made on registered pharmacy premises
(iii) sale by or under personal control of pharmacist
the poisons (N.I) order 1976 part II
(i) lawfully conducting a retail pharmacy business and sale is made on those premises ; or
(ii) seller registered by district council ( registered seller of part II poisons)
the poisons (N.I) order 1976 - restrictions of sale
may not sell part I poisons unless-
(i) buyer has a cert ; or
(ii) buyer is known by seller to be a person to whom the poison may properly be sold
what must a seller do before supplying a poison
(i) make register entry
(ii) have register signed
the poisons regulations (N.I) 1983 introduced
listing poisons in schedules
further regulating the sale , supply , labelling and storage of poisons
restriction of the sale of cyanides
form of registers/certificates
sales of schedule 1 poisons - knowledge of purchaser
knowledge of the purchaser :
(a) known to seller as someone to whom the poison may be properly sold ; or
(b) certified in writing as someone to whom the poison may be properly be sold
sales of schedule 1 poisons > records

name and address of purchaser and business/trade or occupation
name and address of householder
name , quantity and purpose
signature
storage of schedule I poisons
(1) cupboard/drawer solely kept for P1 S1 poisons or
(2) in a section of premises partitioned from rest of premises
(3) shelf used solely for P1 S1 poisons
schedule 12 - list of poisons for which there are special restrictions
sold only : by way of wholesale dealing or export for scientific education/research
examples : arsenicals , zinc phosphide , thallium ,strychnine

a home office licence is now required to import/acquire/possess/use
retail sales/supplies from a registered pharmacy by or under supervision of a pharmacist
record keeping requirements apply and these must also be recorded on the purchaser’s licence
suspicious transactions and thefts must be reported

no home office licence is required to import/acquire/possess/use
retailer does not have to be included in list of registered sellers
can be supplied if the request is not suspicious and after considering whether more appropriate commercial alternatives are available
