Who is a murtad?

A

A murtad is someone who after accepting Islam, rejects a key belief of Islam. He speaks words of disbelief in which there is no room for correct interpretation. One can also become a murtad through their actions for example putting the Quran in an impure place.

A

Intellect- a child or a mentally ill person will not qualify

sanity- a mentally ill or intoxicated person will not qualify

Choice- there is no harm in uttering such words if one’s life is in danger provided that he still believes it in his heart

What is the punishment of the murtad?

A

It is mustahab for a ruler of Islam to re present Islam to a murtad. If he rejects, he should be kept in prison for three days and invited to Islam each day. If he still rejects, the ruler should kill him. This is not possible in todays society so it is better to cut ties with them.

A

This is taken as repentance however other rulings of leaving Islam will apply. For example, deeds will be nullified, he will lose nikkah to his wife, and previous Hajj will be nullified.

If one has accepted beliefs against Islam from random speeches unknowingly, this is neither repenting nor rejecting. One should avoid this by repenting regularly.

A

A person must show hatred towards the religion which he converted to. He must take back the specific belief that he rejected. For example, if one rejects the belief that pork and alcohol are Haram, he must take back his word.

A

One must repent and mention the disbelief committed in repentance. He must also hate it in his heart. Even if one is unsure weather or not he committed disbelief he should repent. He should then recite the kalima.

A

He will need to make up for missed worship from before. He will not need to repeat worship which he already did, but it will be nullified. Hajj however must be repeated if one has the means.

A

If it is definite kufr, then the woman is out of marriage. They may remarry if he re accepts. If he keeps the woman without re marrying this is Zina.

A

One must do a nikkah with new dowry. Two Muslim men or one Muslim man and two Muslim women must be present. It is wajib to give at least 10 dirhams for mehr. The sermon may be recited and surah Al fatiha should be read. After marriage the woman can forgive her dowry but only from her own will unless the man asks for a shari reason.

A

Words with different meanings cannot make a person a disbeliever so he should be given benefit of the doubt, unless he admits that his intention was that of disbelief. Similarly, a disbeliever should be called a disbeliever because in the Quran a disbeliever is called as such and in Surah Kafiroon this ruling is given.

Rules which are different for Disbelievers and Muslims include: do not attend their funeral prayer, do not ask for their forgiveness, do not give your daughters to them, perform jihad on them, and take jizyah from the men.
