What is the MHA?
- says when you can be TAKEN to the HOSPITAL, KEPT there and TREATED against their wishes
- only put under the MHA, if there is no other way to keep YOU or others safe
Can you be detained for drug or alcohol addiction?
- NO
- unless you are experiencing mental health problems FROM the substance use (DELUSIONS from the cannabis use)
Who decides whether a patient should be detained?
3 people may call the implication of the detention
- an APPROVED mental health professional (AMHP)
- another doctor
- a doctor who has a special training in mental d.o
- FY2
How do they asses you and decide if you need to detained?
- how the pt is feeling
- if you have plans to harm yourself
- about your lifestyle, daily routine and living conditions
- if you have been taking MEDICATIONS, drugs or alcohol
What does section 2 of the MHA address?
- kept in the hospital for up to 28 days
-allows time for the doctor :
> figure out what mental disorder
> if rx is needed
> how the rx may affect you
Can pt refuse rx under Section 2?
- NO
Can you extend Section 2?
No
- if extension at hospital is required; pt would now be under section 3
How long can you be detained in the hospital for under Section 3? Can this section be approved?
- for up to 6 months, and then 1 year at a time
- ## yes, for another 6 months (last 2 months of the first term; pt should be proper analysed)
Can you be treated against your will under Section 3?
- YES, BUT only for the first 3months
- afterwhich they would have to ask for your consent, if a second opinion doc approves the rx
How is section 4 diff. from section 2 and 3?
- Section 4 being an emergency situation; can detain a person with only ONE doctor recommendation
- Sections 2 and 3 requires 2 doctors
How long can one be detained under section 4?
-for upto 72 hours
Can you refuse rx when under SECTION 4 ?
yes, UNLESS you don’t have the MENTAL CAPACITY to make an informed decision and if the rx is in YOUR best interest
