Regulations were updated for the use of positive behavioral supports techniques, safety techniques, and other best practices.
What is the role of the internal reviewer?
Monitor the facility’s use of restraints.
What is the role of the external reviewer?
Issue a written report every three months informing the Department where the facility is in substantial compliance with the agreement and the policies incorporated therein. Issue quarterly reports to the Court for the duration of the Agreement. Shall have full enforcement authority consistent with the Office of Health Facility Complaints’ authority set forth. Shall have access to the facility and its records, including the medical records of residents for the purpose of ascertaining whether the facility is complying with the Agreement.
What is the Olmstead Planning Committee?
A committee including individuals with disabilities, family members, providers, advocates and senior decision-makers from the Minnesota Department of Human Services. They make recommendations to the commissioner of the Department of Human Services. Members were either appointed as part of the settlement agreement or by mutual agreement between the Minnesota Department of Human Services and the Plaintiffs from a diverse pool of interested persons from around the state through a public application process. Members were not paid for their service. Supports full integration for people with disabilities into their communities with their choices in employment, housing, transportation, supports and services, lifelong learning and education, healthcare and healthy living, and community engagement.
What were the amounts of monetary settlements to clients who were at METO?
$75,000 for each of the three named plaintiffs. Settlements were based on the number of times the member was restrained and/or secluded with the schedule providing for approximately $200 per incident. 140 individuals received less than $3000, 31 received more than $10,000, the top three received six figures (approximately 200 total individuals).
