5 criteria for detention under the mental health act?
likely mental disorder
significantly impaired decision making ability
determining treatment required (giving treatment - STD and CTO)
significant risk
- to health, safety or welfare
- to safety of others
informal/voluntary care
SIDMA vs incapacity?
SIDMA = mental health disorder alone incapacity = also disease of the brain, physical disability, impaired cognition
reason for detention in hospital?
patient refuses to stay in hospital
incapable of making a decision about it
too risky to treat in community
components of emergency detention order?
up to 72 hours detention
does not authorise treatment against will
must be fully registered doctor (FY2 or above)
mental health officer should also agree where possible
likely mental disorder
no right of appeal
components of short term detention order?
up to 28 days for assessment/treatment
approved medical practitioner plus an MHO
likely mental health disorder
right of appeal (patient and named person)
can be extended by 3 days if extra time is needed to put together an application for a CTO to 5 days once CTO application submitted
components of compulsory treatment order?
initially up to 6 months
approved medical practitioner plus mental health officer
menal disorder present
reports from 2 independent doctors (2 AMPs or AMP and GP), a care plan and MHO report
MHO makes the application to tribunal service
mandatory tribunal
treatment authorised (up to 2 months of detention)

exceptions
- ECT
- artificial nutrition
- vagus nerve stimulation
- transcranial magnetic stimulation
- any medicine given for the purpose of reducing sex drive
- neurosurgery (with patient consent or additional protections)
(these would need extra advice/certification etc)
what is an advance statements?
written statements signed when the person is well about how they would like to be treated if they were to become ill in the future
witnessed and dated
tribunal involved?
who is a named person?
person chosen by patient to support them and protect their interests
same rights to be notified, attend tribunals etc
advocacy?
every person with a mental health disorder has a right of access to advocacy
mental health tribunal?
Tribunal of the Scottish Government to hear applications for, and appeals against, Compulsory Treatment Order, and appeals against Short Term Detention
how long can nurses hold patient in hospital under nurses holding power?
up to 3 hours
power of police under mental health act?
removal to a place of safety
(remove from a public place only, not their own home)
appears to have a mental health disorder and is in need of care and treatment
up to 24 hours for assessment to be carried out
