How long does section 2 of the MHA last?
28 days
Whast is the purpose of section 2 of the MHA?
for assessment (although teatment can still be done without pt consent)
Who does the assessment?
2 doctors (one S12 approved and one who preferably knows the patient), AMHP
What is the evidence required to carry out section 2 of the MHA?
a) The patient is suffering from a mental disorder of a nature or degree that warrants detention in hospital for assessment; and
b) The patient ought to be detained for his or her own health or safety, or the protection of others
How long does section 3 of the MHA last?
6 months including 28 days of section 2 if used
What is the purpose of section 3?
Treatment
What is the evidence required to carry out a section 3?
(a) The patient is suffering from mental disorder of a nature or degree which makes it appropriate for the patient to receive medical treatment in a hospital; and
b) The treatment is in the interests of his or her health and safety and the protection of others; and
c) Appropriate treatment must be available for the patient
What is a 5(2)?
For a patient ALREADY admitted (can be psychiatric or general hospital) but wanting to leave
Doctors’ holding power – 72 hours
How long does a 5(2) last?
72 hours
Can you treat someone against their will under a 5(2)?
no
What is a 5(4)?
nurses holding power which lasts 6 hours
What is a section 17?
community treatment order
you can get leave but can be recalled to hospital if, for example, you stop taking required medication or your condition gets worse.
