When should the MHA be used?
If there is presence of mental disorder which is of a certain nature or degree resulting in a significant risk to a persons health and safety with no alternative to hosp admission as a means of safeguarding that risk

mental nurse holding power can detain informal pt for 6 hours

Doctor holding power for 72 hours to detain informal pt
section 2
2 drs and 1 approved mental health practitioner (AMHP) can section for 28 days for assessment. cannot be renewed.
section 3
2 doctor and 1 AMHP can section for max 6 mths for treatment. can be renewed.
section 136
police power to remove to a place of safety from public place for an assessment, held for 72 hrs till assessment
section 17
provision for leave whilst detained in hosp under s2 or 3
section 117
anyone who has been under s3 is entitled to s117 aftercare
What factors affect a risk assessment of a pt?
self harm, harm to others, self neglect, exploitation/vulnerability, risks to children and vulnerable adults, fitness to drive
