Mental Disorder
Abnormal state of mind. Characterised by delusions or disorders of mood, perception, volition, or cognition of such degree that it - poses a danger to the health/safety of that person/others
OR seriously diminishes that capacity of that person to take care of him/herself
Restricted Patients
Subject to a C.T.O, considered a present danger to the public
Special Patients
Detained by court order – criminally insane OR unfit to plead OR on remand for psychiatric report
DAO
Duly Authorised Officers – qualified nurses specialised in mental health/ongoing training
Compulsory Treatment Order
Application by any person over 18, relatives or doctors
AWOL Restricted, Special and CTO < 3 months
Apprehend and return patients to hospital
AWOL CTO missing > 3 months
Released from CTO and new application must be completed
Section 109 Mental Health Act 1992 – Mental Disorder in PP
Police may apprehend, any person wandering at large in a PP & reasonable belief behaving in a mentally disordered manner & person/public’s interest.
DAO to examine – Hospital/Station
Section 110 Mental Health Act 1992 – Assist DR
Police may enter premises, by force & detain person until exam conducted OR detain + take person to another place for medical exam until exam has been conducted
DAO to accompany
Section 41 Mental Health Act 1992 – Assist DAO
DAO may call upon assistance from police so that they may, assess a patient OR transport a patient for assessment/treatment
Detention = No more than 6 hours
