What is Assault
Assault is the act of intentionally applying or attempting to apply force to a person, directly or indirectly.
Assault could be?
Intentionally applying force directly

Conditional assault- threats of harm “your money, or your life.”
Assault could be 4?
Implied assault- No consent to follow though with an action. Kiss, hug, hand shake etc.

Transferred malice- offender punches a bystander instead of there intended victim.
Element: Assaults
Acts of intentionally or attempting to apply force to a person directly or indirectly.
OR
Threatening by any act or gesture to apply such force to a person of another.
Element: Another person
It has to be another person other than the offender.
3 factors and what they mean
The intent- scare injure or kill?
Weapons and degree of force- Was it a big hit or small hit, we’re weapons involved.
Injury received- did the victim sustain any injuries or wounding?
Which acts are assault in?
Summary offences act 1981 and Crimes act 1961.
