MAID definition
Administration of a substance to cause a patient’s death
Giving the patient a substance so they can self-administer to cause their own death
Criteria for MAID
- Have to be eligible for Canada Health Services (Be a Canadian Citizen)
- Older than 18 years old and is capable of making health decisions
- Medical conditions causes physical or psychological suffering (Does not include mental conditions)
- Voluntary consent for MAID
- Informed consent after being informed of all other alternatives
- Informed consent at time of request and immediately before MAID
Two Track Approach
Natural Death is Forseable
- Easier to go through safeguards
Natural Death is not Forseable
- Extra steps to provide patient with sufficient time if they change their minds
Natural Foreseeable Death
- Safeguards
- Medical/Nurse Practitioner deems that patient meets criteria for MAID
- Documentation of informed consent of MAID
- Second independent Medical/Nurse Practitioner provides written opinion that patient meets criteria
- Reliable means of communication with patient
- Immediately before MAID informed consent is given by patient
Natural Unoreseeable Death
- Safeguards
All of the same requirements Natural Foreseeable Death, plus:
- Have to consult with an expert on patient’s conditions
- Have to offer other options for relieving suffering
- Have to ensure patient has given serious consideration to other options
- MAID can only occur 90 days after first assessment unless loss of capacity is imminent
