- State of mind of declarant
- Independent Legal Significance
- Legal significance is unclear: statements must accompany and explain its legal its legal significance.
- Knowledge of particular fact by declarant.
- Effect which it had on listener.
- Non-verbal conduct that does not assert anything is not hearsay.
- Negative results to specific inquiries are allowable.
- Absence of complaint or silence may be admissible to prove existence of a condition.
- Prior inconsistent and consistent statements are admissible to impeach or rehabilitate a witness.
- Knowledge of a fact, the existence of which is shown by other evidence.
- Identity of declarant; time place or; relationship.
- Non-human declarants are not hearsay.
