  1. State of mind of declarant
  2. Independent Legal Significance
  3. Legal significance is unclear: statements must accompany and explain its legal its legal significance.
  4. Knowledge of particular fact by declarant.
  5. Effect which it had on listener.
  6. Non-verbal conduct that does not assert anything is not hearsay.
  7. Negative results to specific inquiries are allowable.
  8. Absence of complaint or silence may be admissible to prove existence of a condition.
  9. Prior inconsistent and consistent statements are admissible to impeach or rehabilitate a witness.
  10. Knowledge of a fact, the existence of which is shown by other evidence.
  11. Identity of declarant; time place or; relationship.
  12. Non-human declarants are not hearsay.
