Four basic considerations relating to character evidence problems
1) What type of case is it? (Civil or Criminal)
2) Who is offering the character evidence?
3) For what purpose is the evidence being offered?
4) What form of character evidence is being offered?
Reputation Evidence
Evidence which relates to what the general community thinks about an individual.
Opinion Evidence
Evidence which relates to what one particular person is willing to state that they believe regarding the person.
Specific Acts Evidence
Evidence which relates to specific acts of a person which create the belief in the witness as to that person’s character.
Habits Evidence
Evidence which describes a person’s regular response to certain set of circumstances.
Custom Evidence
Habit evidence in the setting of business.
