Lesson 1 Flashcards
Evidence
Any matter, verbal or physical, that can be used to support the existence of a factual proposition.
Direct Evidence
Evidence that proves a proposition without relying on any inference.
Indirect or Circumstantial Evidence
Evidence of a subsidiary fact from which the existence of an ultimate fact may be inferred.
Logical Relevancy
Evidence is logically relevant if it has materiality and probative value.
Materiality
Evidence is material if it tends to show the existence or non-existence of an element that is derived from the controlling substantive law.
Probative Value
Evidence has probative value if it tends to establish the proposition that it is being offered to prove.
Legal Relevance
The trial judge may exclude logically relevant evidence if its probative value is substantially outweighed by the danger of unfair prejudice.
Doctrine of Limited Admissibility
Evidence may be admissible for one purpose, but inadmissible for another purpose.
