Lesson 9 Flashcards
Direct Examination
During direct examination, an attorney is limited to questions that call for a specific answer from the witness.
Leading Question
Counsel cannot phrase questions to a friendly witness in such a way as to suggest to the eyewitness the answer the attorney desires.
Cross Examination
Cross-examination is limited to matters to which the witness testified under direct examination.
Argumentative
The purpose of an argumentative question is to persuade the trier of fact rather than to elicit information.
Compound
A question is compound if it contains two or more questions.
Non-Responsive
A non-responsive answer goes beyond the scope of the question and includes subject matter not called for by the question.
Assuming facts not in evidence
A question that assumes unproved facts to be true is objectionable as it seeks to bring unproved facts before the trier of fact.
Impeachment
Impeachment involves intrinsic or extrinsic evidence aimed at discrediting the testimony of a witness.
