During the procurement of the fender panel package at Dover, subcontractor would not initially agree to the inclusion of delay damages and had leverage due to the specialist nature of the work. A meeting was held where I was able to obtain a win-win agreement by agreeing including LD’s in the contract but conceding to include a liability cap on the extent of LD’s.
