Jus in Bello Flashcards
What are the two main Jus in Bello principles?
- Principle of proportionality
- Principle of discrimination
What is the principle of proportionality?
The use of weapons must be in proportion to the threat posed
Give an example of a war following the principle of proportionality
Using carefully targeted bombs against buildings known to be attack bases
What is the principle of discrimination?
The idea that those waging a war should discriminate between civilians and non-civilians to ensure that civilians are not harmed. There should be no attacks that target civilians or put them at risk
Give an example of a war following the principle of discrimination
One that ensures no or minimum civilian deaths
What does Coady say about the principle of discrimination?
He says it is impractical to have a war in which no civilians are harmed. Says civilian deaths are only just if they are an unintended side effect of a just act of war
What does Shue say about the principle of discrimination?
Supports the principle by saying that attacks on civilians undermines the morality of those fighting
What does Bowie say about the principle of discrimination?
Says that if the civilian population supported a war that was unprovoked, then they are guiltier than the soldiers trying to defend themselves
