Cabotage

A

A state shall have the right to refuse permission to the aircraft of other contracting states to take on its territory passengers, mail and cargo for remuneration or hire and destined for another point within its territory.

Each contracting state undertakes not to enter into any arrangements which specifically grant any such privilege on an exclusive basis to any other state, or an airline of any other state and not to obtain any such exclusive privilege from any other state.

  • Precision in procedures and systems is made possible by the existence of universally accepted standards
  • known as Standards and Recommended practices (SARPs) these are written by the technical divisions and published for adoption worldwide following consultation.
  • These are written into ICAO Annexes.

SARPs

A

SARPs are formulated in broad terms and restricted to essential requirements.

For complex systems such as communications equipment SARPs material is constructed in two sections.

1) Core SARPs - material of a fundamental regulatory nature contained within the main body of the Annexes.
2) Detailed Technical Specifications- placed either in appendices to Annexes or in manuals.

Differences- The differences to SARPs notified by member states are published in supplements to Annexes.

These standards are used to write our ANO schedules relating to licensing of many discipline including pilots and controllers.

Annex 2 - Rules of the Air

A

The rules in annex 2 consist of general rules, visual flight rules and instrument flight rules and apply without exception over the high seas and over national territories of the extent that they do not conflict with the rules of the state being overflown.

These are incorporated into our MATS part 1 and ANO.

A

Annex 11 defines air traffic services and specifies the worldwide standards and recommended practices applicable in the provision of these services.

Decision Making

A
  • Ideas or proposals to amend the annexes are discussed in a variety of meetings and at the assembly.
  • The proposals then go on to the ANC and ultimately are recommended to the council, where they approved or rejected.
  • At ICAO, the consensus building is admirable and usually successful.
  • However, it also implies that the implementation of some decisions is very time consuming.
