Two types of human rights
Civil and political rights
Social and economic rights
Health as a right
Creating opportunities for people to reach their full health potential, either through the right of access to health care, or through underlying rights necessary for health, such as the right to clean water and adequate food.
Human rights and the health professional
- obliged to see that they are not responsible for violations of human rights
- can act as advocates to speak out if they see a human rights violation and to promote and fulfil human rights
Four ways government has to meet its obligations to any human right
- state has to respect the right ~ can’t do anything that interferes directly or indirectly with the right to health
- state must protect a human right by taking steps to ensure that no third party interferes with a persons access to health care
- people have to know about rights to claim them ~ state has to provide information that enabled patients to make informed decisions about their health
- state must take positive measures, such as budgetary resources, passing laws And establishing policies and administrative procedures, toward fulfilling the right
Progressive realization
Implies that a person cannot claim an absolute and immediate right to receive health care; rather, the state must, with the resources available, do its best to provide access, and continually improve that access
Vulnerable groups
A group of persons who share something in common that makes them powerless in protecting their health
UDHR goals
Wants everyone to enjoy the right to ‘a standard of living adequate for the health and well-being of himself and of his family including food, clothing, housing and medical care and necessary social services’
Also singles out vulnerable conditions of motherhood and childhood for special protection
ICSECR goals
Provides the right to health as the “highest attainable standard of physical and mental health” and states that government had an obligation to prevent Ill health as well as provide services that improve environmental and industrial hygiene.
African charter on human and people’s rights
Emphasizes group rights and the importance of family as central to the realization of rights - also speaks of health as the right to enjoy best attainable state of physical and mental health
Batho Pele programme
Developed by government as part of. The plan to transform public sector service delivery by “putting people first”
Human right
fundamental rights each human has by fact that they are human
Human rights are universal and are meant to be applied to every person on the planet. They therefore, in theory, cannot not be created or taken away by any governments.
