A

Control of Asbestos Regulations 2012 obligations to the duty holder and the employer.

Non-licensed work with asbestos needs to be notified to HSE. Brief written records should be kept for notifiable non-licenced works.

RICS Professional Standard Asbestos – contains an comprehensive overview of law and industry guidance and sets out best practice.

Who is the duty holder within the Control of Asbestos Regulations?

What should the duty holder do if they find it?

A

To the Duty Holder – the owner of the premises if vacant or a tenant if holding a repairing lease.

Duty holder must assess whether the premises contain asbestos and if so where it is and what condition it is in – if in doubt materials must be assumed to contain asbestos

Assess the risk and produce and asbestos management plan – is encapsulating / removal needed

Produce an asbestos register

Make the register available to all relevant parties who might disturb it

Review the register regularly (HSE recommends 6 monthly)

o Defence – Person took all reasonable precautions and exercises all due diligence.

o Health and Safety (Offences) Act 2009 enables fines of maximum £20,000 and possibility of 12 months in prison.

I am aware of the Fire Safety Act that came into effect in Jan 2023 following the Hackitt review and amends the Fire Risk Management Regulatory Reform Order 2005.

Requirement for a regularly updated FRA (flats and houses in multiple occupation inc common parts). - responsible person to carry out this assessment.

Allows the Fire Service to take enforcement action with additional mandatory requirements for blocks over 11m and 18m.

Ensure evac plans and personal evac plans are place and residents are provided with suitable fire safety instructions.

A

Superseded. FSO based on risk assessment and fire prevention applying to non domestic property.

A responsible person is the employer, or occupier who controls the property. Matter covered in Part B of the Building Regulations.

A

Construction Phase Plans to include:
start and finish dates, service connections/disconnections, build stages. Where the services and isolation points are, access restrictions, asbestos presence etc.

Site rules, H&S information key decision makers, main dangers (falls from height, collapse of excavations, collapse of structures, exposure to dusts, exposure to asbestos, risks to members of public)

Construction phase plans must be completed before work starts on site. Work can’t legally begin without one in place. A construction phase plan should be treated as a live document and updated as work progresses. If designs, plans or project arrangements change, the plan should be added to as necessary.

A
