Post the Grenville Tower disaster, what have the government done to combat building safety?
Gove re-cladding pledge March 2023 = threatened with nationwide ban if they fail to sign pledge to replace flammable materials on buildings over 11 metres.
What is an External Wall System (EWS) and what is the purpose an EWS1 form
Cladding
Used to value tall resi buildings enables a qualified professional; to confirm that an EWS on residential buildings has been assessed for safety.
These are valid for five years. An interactive decision tree is available on the RICS website to determine when an EWS1 is required

Basic good practice principals for management of health & safety for RICS regulated firms e.g. workplace H&S and for visiting sites.
What four things does Surveying Safely say RICS regulated firms need to ensure they provide?
What is meant by a ‘Safe Person’?
RICS regulated firms:
1. Safe working environment
2. Safe working equipment
3. Safe systems of work
4. Competent staff
Concept of a ‘Safe Person’ = individuals should assume their own behavioural responsibility for their own, their colleagues and the publics H&S whilst at work.
What does surveying safely state about site visits?
Tell someone where you are going and when you leave the building site.
Ensure you have appropriate PPE.
Sign in and sign out and receive a site induction.
Consider whether it is safe to inspect alone.
Why was Surveying Safely created?
Health & Safety at work Act 1974
Duty of the employer to reasonably ensure the health and safety at work of all employees.
Difference between a hazard and a risk?
Hazard = something that could cause harm
Risk = Likelihood of a hazard occurring
What is the 5-step approach for an H&S risk assessment?
Identify = HAZARD
Who is at risk
Assess the likelihood and severity of any accidents.
Record the findings on a suitable form
Review the risk assessment regularly
When are companies required to have a written H&S risk assessment document?
When they have more than 5 employees.
What should a companies health and safety document contain?
Policy setting out organisations commitment to H&S

Details of the implementation of the H&S policy
How would you check your PPE is in date?
Following the PPE at work regulations 2022. Undertake regular audits on site and check stamp dates on packaging.
What do Countryside do to mitigate fire risk on their new builds?
Compliance with legislation
Regular auditing and QA process from fire consultant to ensure compliance.
What are the main fire safety regulations post Grenfell?
Fire Safety Act 2021 and Fire Safety Regulations 2022.
What did Hackitt find?
“the current system of building regulations and fire safety is not fit for purpose and that a culture change is required to support the delivery of buildings that are safe, both now and in the future”
recommended the appointment of duty holders
What is the Countryside’s H&S policy?
My firm’s H&S policy requires me to:
- Raise concerns/issues on site/office
- Undertake training/learning when required
- Report incidents, raise this with my line manager and record it in the Incident Report Database
For all incidents I call a number, and they ask relevant questions.
Photos are to be taken immediately
SHE has 24 hours to commence investigation

What is asbestos? How many types of asbestos are there? How does asbestos cause lung damage? When was asbestos banned?
Asbestos is an insulating material which can cause serious health problems and fatal diseases if left undamaged and undisturbed it posses to risk. However, when disturbed it can cause illness.

What legislation are you aware of in relation to asbestos?
Control of Asbestos Regulations 2012 obligations to the duty holder and the employer.
Non-licensed work with asbestos needs to be notified to HSE. Brief written records should be kept for notifiable non-licenced works.
RICS Professional Standard Asbestos – contains an comprehensive overview of law and industry guidance and sets out best practice.
Who is the duty holder within the Control of Asbestos Regulations?
What should the duty holder do if they find it?
To the Duty Holder – the owner of the premises if vacant or a tenant if holding a repairing lease.
Duty holder must assess whether the premises contain asbestos and if so where it is and what condition it is in – if in doubt materials must be assumed to contain asbestos
Assess the risk and produce and asbestos management plan – is encapsulating / removal needed
Produce an asbestos register
Make the register available to all relevant parties who might disturb it
Review the register regularly (HSE recommends 6 monthly)
o Defence – Person took all reasonable precautions and exercises all due diligence.
o Health and Safety (Offences) Act 2009 enables fines of maximum £20,000 and possibility of 12 months in prison.
What is CDM? Role of the client for this?
Construction (Design and Management) (CDM) Regulations 2015. H&S During design and management of all commercial, residential building works.
The Aim is to improve the management and co-ordination of H&S at all stages.
The main duty holders are the client, the principal designer and the principal contractor
What is the HSWA 1974?
Primary UK legislation governing health and safety.
Sets out duties of employees, directors, self-employed, person in control of a premises, suppliers. They must safeguard the H&S of public employees who may be affected by their works. Enforced by the HSE
How does the HSWA protect individuals?
Duty to every employer to ensure as reasonably practicable the health and safety and welfare of employees at work
Policed by Health and Safety Executive
Must report injuries and dangerous occurrences (1995 regulations)
Give an example of a hazard?
Contractors working at height, with hot works, in excavations etc. Fire risk, lifts, legionella, and asbestos
What would you consider if you visited a site to conduct a review of the site constraints?
I would consider my personal safety ensuring I followed my firm’s H&S procedures for site inspection.
