Define discrimination
An act, practice, or pattern of behaviors based on an individual’s race, color, religion, sex, national origin, age, genetic information, disability, military service, sexual orientation, gender identity or expression, or political affiliation which has an adverse impact on an individual or identifiable group compared to the impact of members of other identifiable groups.
Harassment defined:
Any conduct based on an individual’s race, color, religion, sex, national origin, age, genetic information, disability, military service, sexual orientation or expression, or political affiliation that has a purpose or effect of unreasonably interfering with an individual’s work performance or creates an intimidating, hostile or offensive work environment.
Prevention
Responsibility for supervisors to prevent acts of harassment or discrimination.
6 things to monitor or avoid
- Monitor the work environment daily for signs of harassment or discrimination
- Refrain from participating or encouraging actions which could be perceived as H an D.
- Counsel members on prohibited behaviors
- Stop any observed acts that may be considered H and D.
- Take action to immediately separate two members where a complaint has been initiated or filed.
- Report all complaints to EDS.

Types of complaints:
Discrimination - adverse impact or disparate treatment.
Define adverse impact:
Example - a substantially different rare of election in hiring, promotion or other employment decision which works to the disadvantage of members of a protected class.
Define disparate treatment:
A member is intentionally treated differently from other similarly situated member because the other members status in a protected class.
Define Harassment:
Any conducted based on a members status in a protected class that’s purpose or effect of unreasonably interfering with an individual’s work performance or creates an intimidating, hostile or offensive work environment.
Includes persistently annoying, offensive or derogatory comments, jokes, pictures etc.
Examples of sexual harassment
- Rape, sexual assault, sexual battery, sexual coercion or other sexual violence.
- Sexually explicit or gender related statements, comments, jokes.
- Other than customary handshakes, uninvited touching, patting, hugging or inappropriate touching
- Remarks of a sexual nature about a person’s clothing or body.
- Use of electronic mail or computer dissemination of sexually oriented, sex-based communications
- Requests for sexual favors in exchange benefits.
- Display sexually suggestive objects
- Inquiries, remarks, or discussions about an individual’s sexual experiences or activities
Define Retaliation:
A form of discrimination against an individual, who has complained, assisted or otherwise participated in complaints of harassment and or discrimination. Retaliation occurs when an individual has:
A. Complained, assisted, or adverse employment actions:
B. Been subjected to adverse employment actions
C. A casual link exists between A and B.
