At what use of force level is an incident report required?
Any physical touch by the officer.
What use of force level is the “Use of Force” form required to be filled out?
Touch or transport holds if resistance occurs, otherwise pain compliance, take downs, restraints, or above.
What are Garrity rights?
The right of an employee to not be compelled to make incriminating statements against themselves to maintain their employment . Also compelled statements cannot be used against an employee in criminal prosecutions.
What are Weingarten rights?
The right of the union member to have union representation present while they are being questioned by management.
If Weingarten use invoked management may:
1). stop questioning until a representative arrives
2). Reschedule the interview when the rep can be there.
3). they may proceed with their investigation without an interview.
When a deputy is dispatched to a “rides for recovery” what steps do they take?
1) . Search the individual, if the individual will not be searched they are not eligible.
2) . Any personal use drugs found will be logged into property for destruction. ( no charges sought)
3) . Have the person complete the “eligibility form” and “consent to transport form”.
4) . Make sure person is 18 or older, is not in medical distress, and has no warrants.
5) . Call the crisis center and inform them of the transport.
6) . Write a report with the name of the treating personnel at the crisis center.
When arresting a subject for a felony, how can you tell if you need to take a DNA sample?
Check the CCH, if the DNA record says “record available” you do not need to take another DNA sample if the DNA record says “no” you will need to take a sample.
When arresting a subject for a felony, who’s responsibility is it to ensure a DNA sample has been collected?
The arresting or lodging Deputy
What is the penalty for refusal to submit to a DNA sample?
One year misdemeanor
What happens to the DNA sample if the suspect is acquitted?
The OIC is responsible for contacting CODIS and making sure the DNA sample is destroyed
In the use of force policy, what is the standard that the sheriffs office uses?
That the use of force would have been “objectively reasonable” to another deputy on scene
A Deputy is authorized to use force in a reasonably necessary manner when?
To protect people from immediate physical harm,
to restrain or subdue an individual who is actively resisting arrest,
to bring an unlawful situation safely and effectively under control,
and maintain proper custody of a prisoner.
Are deputies authorized to use chokeholds?
Chokeholds are forbidden except in cases where deadly force is authorized
When are deputies authorized to use intermediate weapons (Baton, OC spray, Taser, pepper ball…)?
Only in cases where the suspect is actively resisting
When are Deputy’s authorized to use deadly force?
When the Deppe a reasonably believes that the suspect poses an eminent danger of death or great bodily harm
When are Deputy’s required to seek medical attention for a suspect?
If the suspect has:
visible injuries
suspected injuries
if they complain of being injured or are in continued pain
if they do not reasonably recover from the effects of an intermediate weapon
If they display symptoms or behaviors that would indicate that the person maybe ill or injured
