Can reserves and Marine deputies engage in vehicle pursuit?

Deputies may only engage in a vehicle pursuit if the Deputy has reasonable cause to believe what?
That the person has committed a felony, is committing a felony, or is about to commit a felony.
Can the crime of fleeing and eluding by it self justify a pursuit?

In determining whether or not to pursue a vehicle, Deputy’s shall consider which factors?
1) nature of the violation is a felony
2) the presence of pedestrians and traffic conditions
3) population density in the area
4) road and weather conditions
5) familiarity with the area
6) patrol car capability and condition
7) familiarity with the violator
Can deputies engage in a Pursuit with a civilian rider in the car?
No
Can deputies engage in a pursuit with a prisoner in the car?

When a pursuit is initiated what shall deputies immediately do?
Activate their emergency lights, siren, in car video, and microphone. Until the pursuit is terminated
In the event emergency lights or sirens fail during a pursuit what must a deputy do?
Immediately terminate the pursuit, and notify Dispatch of the equipment failure
Can motorcycles engage in a vehicle pursuit?
No
Can vehicles engage in a pursuit if they do not have lights and sirens?

The deputy in the primary pursuit unit is responsible for giving Dispatch what information?
1) Location and direction of pursuit
2) reason for pursuit including nature of violation (felony)
3) Description of the vehicle including license plate number
4) number of occupants in their description
Upon being notified of a pursuit the dispatcher shall do what?
1) locate a back up unit to assist
2) Obtain LEIN information on the vehicle
3) Alert other police agencies in the apparent path of the pursuit.
4) Notify the pursuing Deputy’s immediate on duty supervisor in command Sergeant
If another deputy joins the pursuit what are their responsibilities?
1) Notify Dispatch upon joining the pursuit
2) never attempt to pass the primary unit unless requested to do so

No more than four
When a semi marked car initiates a pursuit and then the pursuit is joined by a fully marked car what must happen?
The semi marked car must withdraw from the primary position and assume a secondary position.
Vehicle pursuits shall be terminated under what circumstances?
1) The primary unit believes the danger created outweighs the need for immediate apprehension
2) The supervisor believes the danger created outweighs the need for immediate apprehension
3) The violator can be identified in the future and there is no longer in need for immediate apprehension
4) The fleeing vehicles location is no longer known
What is the supervisors role in a pursuit?
To continuously monitor the pursuit, and terminate if the pursuit violates policy or the risks outweigh the necessity to apprehend the violator
Can Deputy’s discharge firearms during a pursuit?
Deputies shall not discharge weapons at or from moving vehicles except when the use of fatal force is justified
Can Deputy’s exit their vehicles and step into the path of a suspect vehicle in order to get it to stop?
No
What are the guidelines for “rolling Road blocks”?
1) Rolling Road blocks are used to gradually slow a fleeing vehicle.
2) Deputy shall not engage in intentional collisions.
3) Civilian vehicles may not be used supplement sheriffs office vehicles. 4) Motorcycles shall not participate. 5) Rolling road blocks may only be used at posted speed’s or less.
When can the PIT maneuver be used?
When all other means of apprehension have been considered and either attempted or rejected as impractical
What is the maximum speed at which the PIT maneuver can be used?
40 mph
Is a PIT maneuver considered fatal force?
The PIT maneuver is considered fatal force on any vehicle with less than four wheels, and is only permitted when fatal force is justified
What vehicles may not be PIT’d for any reason?
Any vehicle Placarded as having hazardous materials on board, or any pick up truck carrying passengers in the bed
Where should the PIT maneuver be avoided?
On bridges, overpasses, or elevated freeway interchanges; Unless no other reasonable options for terminating the pursuit are available.
Who can authorize a roadblock?
Only Sgt or above
When can a total roadblock to be authorized?
Only when apprehending a fleeing felon when the use of fatal force is justified
When may a partial roadblock be authorized?
When there is substantial risk that continued operation of the vehicle may cause serious injury or death to another person
What are the general guidelines for roadblocks?
Road blocks shall be established in locations where the operator of the fleeing vehicle has sufficient visibility and distance to stop their vehicle.
Emergency warning lights on patrol cars shall be on
If a deputy becomes involved in a crash while operating a patrol car who investigates?
A Sgt or above
Can deputies be disciplined for their decision to terminate a pursuit?
Deputies will not be criticized or disciplined for their decision to terminate pursuits
At the end of a pursuit, what must the initiating Deputy do?
Fill out the vehicle pursuit form along with an incident report. Both must be submitted to the Sgt prior to the end of the shift
What does the sergeant do with the vehicle pursuit form and incident report?
The vehicle pursuit form, copy of the incident report, crash report (if any), and video of the pursuit are sent to the division captain for review. Training will also be sent a copy for review.
