federalism Flashcards
federalism is a structure of politics and government in which
power is divided between a national government and state governments , both of which have signifiant control over clearly defined areas of government
the power of the state is protected from fed encroachment by
the constitution and ammendment process
importantly all states have
the same level of decision making power
the founding fathers intended federalism to be a
middle ground between a strong central gov and protecting the rights and sovereignty of states
federalism isn’t explicitly stated in the constitution however
it is implied through how the constitution sets out the powers of the fed gov and their limits
the articles of the constitution explicitly set out the enumerated powers that both
the states and fed gov have including the power to tax
the elastic/neccessarry and proper clause also gives the federal gov …
implied powers stemming from the enumerated powers
the 10th amendment clearly seeks to protect the power of states however by
reserving all powers not given to the federal to the states
the supreme court as the interpreter and enforces of the constitution also clearly takes on the role of
arbitrating between the states and federal government when disputes arise
