Supreme Court upheld death penalty laws which required judge and or jury to take into account specific aggravating factors in making decision and it authorized a “bifurcated” proceeding which was a trail to determine guilt
Roper v. Simmons (2005)
Supreme Court struck down death penalty for juveniles under 18 years old when crime was committed
Atkins v. Virginia (2002)
That executing people with intellectual disabilities violates the eighth amendment ban on cruel and unusual punishments
Furman v. Georgia (1972)
Supreme Court ruled that death penalty, as administered constituted cruel and unusual punishment, it invalidated death penalty in 39 states, and 35 states would reenact laws in next few years but the issue would soon return
