Deterrence
The purpose is to prevent crime and this is future focused on changing behaviors and to get people to conform to have a model of obedience. And the arguments against this includes that it’s difficult to measure results and effectiveness
General deterrence
Deter general public,must be continuously reminded ( for example you don’t want to commit a robbery)
Specific deterrence
Deter person being punished - you prevent it from ever happening again ex: death penalty
Incapacitation
The reason for this is for public safety by containment and isolation - lock them up in prison and the argument for this is that it’s really expensive
Rehabilitation
Belief that offenders can change and focused on treatment need over guilt and offense and the goal of this is to restore person to society and to increase pre social skills, change thinking and values
Indeterminate sentencing
Rehabilitation philosophy, min and max terms, the parole board decides the release decision and sentences are often released by g”good time” and the conditional release is often two thirds of max
Determinate sentencing
Fixed year of terms, associated with retribution philosophy and Thr judge typically has the discretion in setting number of years and is released automatically Upon expiration

Determinate sentencing that includes term of confinement and term of extended supervision (example doing communit work)
Adjustment in Wisconsin
You can petition for it and can get an adjustment of confinement term that can reduce 15-25% but has to be non violent crimes

Required minimum term and judged have no discretion and this gives power to the prosecutors to do what they want
Three strikes and you’re out
Special mandatory sentences calling for long prison terms for repeat felons

Reduce discretion and disparity and make sentences inform and predictable
