What is the structure of the RICS?
Executive body of the RICS is the governing council. Beneath these are the standards and regulations Board and RICS board. Below the RICS board is a number of committees
What are the different types of conflicts of interest?
Party - duty to act for a client conflicts with duty to act for another.
Own interest - duty to act for client conflicts with interests at the same client.
Confidential information - duty to provide information for one client conflicts with another client to keep that same information confidential.
What are the minimum requirements for PII?
- Provided by an RICS-approved supplier
- Comply with minimum levels of indemnity listed in the RICS requirements
- Run-off cover of a minimum of 6 years
- Work on a ‘claims made basis’
- Work on an ‘each and every claim’ basis
- Policy wording should be on a full civil liability basis min.
Can you give me an example of a conflict of interest and how you would deal with it?
Seconded to client where Arcadis is also providing engineering services and would require me to certify their AFPs - check if the client was ok with this, obtain informed consent, set-up appropriate measures - separate private SharePoints and offices, separate lines of communication, Sign NDAs and monitor conflict
If you were to start your own practice what would you need to do?
- Inform the RICS by completing a Firms Detail Form.
- Register for regulation
- PI insurance
- Setup an approved compliant CHP (inc. complaints handling officer)
- Setup an account to hold client’s money
- Other insurances (as appropriate)
o Employer’s liability insurance – legally required if the intent is to employee anyone
o building insurance – if a building is owned
o cyber insurance
o public liability insurance - Obtain a logo kit from the RICS to use for the production of all practice material to ensure
- Make arrangements for succession and future running of business if a sole practitioner
- Set up a staff training plan and ensure CPD logged online on the RICS CPD Management System
